These are the rules of the road for proacttraders.com and everything you get from ProAct Traders LLC (“ProAct Traders,” “we,” “us”): courses, memberships, charts and indicators, live rooms, the ProAct Academy, emails and support (together, our “services”). We've kept them as plain as we can. By using our site or buying from us, you agree to them, along with our Privacy Policy, Refund Policy and Earnings & Risk Disclaimer.
Heads up: section 12 says that if we ever have a disagreement we can't work out, it goes to individual arbitration, not a jury trial or a class action. It also tells you how to opt out.
The short version:
- We teach. We don't give advice, call trades or manage money. Every trade you take is your call and your risk.
- What you buy is for you: one person, one login. No sharing, recording or reselling.
- Memberships renew until you cancel, and you can cancel any time. Courses are final sales, because once it's in your head, we can't take it back out.

1. Who can use ProAct
- You must be 18 or older.
- Give us accurate details when you sign up or buy, and keep them current.
- One person per account. Keep your login to yourself; you're responsible for what happens under it.
- We can refuse service to anyone, at any time, for any lawful reason.
2. We teach. You trade.
ProAct Traders is an educational company. We are not a registered broker-dealer, investment adviser or commodity trading advisor. Nothing we say, show or send, on the site, in a course, in a live room, in an email or anywhere else, is financial, investment or trading advice, or an offer or solicitation to buy or sell anything.
Our live rooms are training rooms, not trading rooms. Our method is about reading what the market might do next, so we talk about possibilities in real time. That's never a call to take a trade.
Our charts and indicators show you what the market is doing and has done. They don't predict the future, and they aren't trade signals.
Every trading decision is yours, and so is every result, win or lose. Before you trade, check prices and details with your broker. People at ProAct may trade, and may hold positions in markets we discuss.
Trading forex, futures and CFDs carries a substantial risk of loss and isn't right for everyone. Only trade money you can truly afford to lose. Past performance doesn't predict future results, and examples and testimonials are individual experiences, not typical results and not a promise of yours.
CFTC Rule 4.41: These results are based on simulated or hypothetical performance results that have certain inherent limitations. Unlike the results shown in an actual performance record, these results do not represent actual trading. Also, because these trades have not actually been executed, these results may have under-or over-compensated for the impact, if any, of certain market factors, such as lack of liquidity. Simulated or hypothetical trading programs in general are also subject to the fact that they are designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profits or losses similar to these being shown.
3. What's yours to use, and what isn't
Everything we make, including videos, courses, recordings, the ProAct Academy, charts, templates, indicators, PDFs, names and logos, belongs to ProAct Traders LLC and is protected by copyright, trademark and other laws.
When you buy or join, you get a personal, non-transferable license to use what you've paid for, for your own trading education, for as long as your access lasts. You can save or print a copy or two of our downloadable materials for your own use. You may not:
- share your login, or let anyone else use your access;
- record, download, screenshot or copy our courses, live rooms or Academy videos to share, post or sell;
- resell, rent, publish or teach our materials as your own;
- copy, decode or reverse-engineer our indicators or templates, or use them to build a competing product;
- use our names, logos or trademarks without our written OK.
Break these and we can end your access without a refund (see section 11). Copying our work can also break the law.
4. Charts, indicators and TradingView
Our charts run on TradingView, as invite-only indicators. You need your own TradingView account, and we recommend TradingView Premium or higher to get the most out of the ProAct layout. We give access to the TradingView username you send us, and that access ends when your membership or product access ends.
TradingView is a separate company. Its terms and privacy policy cover your TradingView account, and we're not responsible for its prices, outages or changes. If TradingView changes how invite-only indicators work, we'll do our best to keep you up and running, but we can't promise it.
5. Live rooms and the ProAct Academy
- Schedule: the NY Live Room runs Monday to Thursday. We observe U.S. bank holidays and New York Stock Exchange holidays.
- Closures: the room may close now and then for a trainer's schedule, technical trouble, weather and the like. We'll try to let you know ahead of time. Closures don't earn credits or refunds.
- Recordings: sessions may be recorded and shared with members. What you post in chat, and your name or username, can be seen by others, so keep private details out of it. By posting in a live room, or sending us feedback, you let us use it in our services and recordings.
- The ProAct Academy: included with a paid Charts + Live Room membership. It isn't part of the free trial. The library grows and changes over time.
- House rules: be decent. No harassment, hate, threats or personal attacks; no spam, selling, soliciting or signal services; no impersonating anyone; no viruses or hacking; nothing illegal, and nothing that infringes someone else's rights. We can remove posts, and people, that break the rules.
6. Memberships, trials and payment plans
Charts + Live Room membership
- Monthly or yearly, at the price shown at checkout. It renews automatically at the end of each billing period until you cancel.
- Cancel any time in the ThriveCart customer hub (it's also linked at the bottom of your receipt) or by emailing support@proacttraders.com. Cancelling stops future charges, and you keep access until the end of the period you've already paid for.
- We'll email you a reminder before a yearly membership renews.
- Yearly plans, and the 6-month plan offered after Fast Track, keep their rate for as long as you stay a subscriber. If we ever change the price of a monthly plan, we'll tell you before the new price applies to you.
- The 12-month intro offer from our emails is $699 for your first 12 months, then $699 a year until you cancel, and that rate stays yours for as long as you stay a subscriber.
The free 30-day trial
- For new members, one per person. No card needed.
- It includes the ProAct charts and the NY Live Room, but not the ProAct Academy.
- It simply ends after 30 days. Nothing is charged. To keep going, you join.
Courses and payment plans
- Courses (The 300s, Price Action, Boot Camp and Fast Track) are one-time purchases, and access starts right after you buy.
- If you choose a payment plan, you've bought the whole course and agreed to make every payment. A payment plan isn't a subscription you can cancel. If a payment fails, access may pause until you're caught up, and the rest of the balance stays due.
- Fast Track includes 6 months of Charts + Live Room at no extra cost. Right after you buy, you can choose to keep it going: if you say yes, your membership continues at $99 a month from the end of those months until you cancel, and we email you 7 days before the first charge. If you don't, that access ends with the free months, and we'll invite you by email.
- Or, on that same page, you can cover months 7–12 right away for $349. After that it's $349 every 6 months until you cancel, and that rate stays yours for as long as you stay a subscriber.
Fast Track credit
What you've actually paid for The 300s, Price Action and Boot Camp (not including tax) comes off the price of Fast Track, through a personal link we email you. Credit links and codes are personal, single-use and time-limited, and have no cash value.
Prices, mistakes and taxes
- Prices and offers can change, and a sale price is only good while the sale lasts.
- If we show a wrong price by mistake, we can cancel that order and refund it.
- You pay any taxes that apply.
- Payments are handled by our checkout provider and its payment processors. We never see or store your full card number.
7. Refunds and chargebacks
All sales are final. Our Refund Policy explains why, and the few things we'll always fix. It's part of these Terms.
If there's a problem with a charge, talk to us first. We're easy to reach, and we fix honest mistakes fast. If you file a chargeback on a valid charge, your access ends (indicators included), and we'll give your bank our records: your purchase, your agreement to these Terms, and your access to and use of what you bought.
8. Our services come “as is”
We work hard to keep everything running, but nothing online is fail-safe. There's no guarantee of 100% uptime: servers, platforms and internet connections are involved that we don't control. We can change, add or remove content, features, schedules and products at any time.
Our site links to other websites and tools, such as TradingView, YouTube and brokers. They aren't ours, and a link isn't an endorsement. We're not responsible for their content or what they do.
To the fullest extent the law allows, our services and all information in them are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that our services will be uninterrupted or error-free, or that any information is accurate, complete or up to date.
9. Limits on our liability
To the fullest extent the law allows, ProAct Traders and its owners, trainers, employees and partners won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, trading losses or lost data, arising from or related to our services or these Terms, even if we were told they were possible.
Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
We're also not responsible for losses caused by things outside our direct control, such as equipment, internet or power failures, hacking or viruses, platform outages, severe weather or other acts of God, fire, war, labor problems, emergencies or government action.
Some places don't allow some of these limits. If you live in one, some of them may not apply to you.
10. Covering us if you break the rules
If your misuse of our services, or your breaking these Terms, leads to a claim against us, you agree to cover our reasonable losses and costs, including reasonable legal fees.
11. Ending your access
You can stop any time by cancelling your membership. We can suspend or end your access, without notice and without a refund, if you break these Terms: for example, by sharing your login, recording or reselling our material, abusing others, or filing a chargeback on a valid charge. We cooperate with law enforcement when someone breaks the law. The sections meant to outlast your access (3, 7, 8, 9, 10, 12 and 13) do.
12. Disputes: talk first, then individual arbitration
Talk to us first. Most problems get solved with an email. Write to support@proacttraders.com with your name, what happened and what you'd like. We'll both try in good faith to settle it within 30 days.
If we can't settle it, it will be decided by binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules, not in court. The arbitrator decides the dispute, including whether it has to be arbitrated. Arbitration can be done by phone, video or written submissions, and fees are paid as those rules set out.
No class actions. You and we each bring claims only individually, never as a plaintiff or class member in a class, collective or representative action. If this class-action waiver is found unenforceable for a claim, that claim goes to court instead of arbitration.
Exceptions: either of us can take an individual claim to small claims court, and either of us can go to court to stop someone infringing intellectual property, like copying our courses or indicators.
You can opt out. If you'd rather not arbitrate, email support@proacttraders.com within 30 days of first agreeing to these Terms, with your name, your email and the words “I opt out of arbitration.” Opting out doesn't change anything else here.
13. Which law applies
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules, and the Federal Arbitration Act governs section 12. Anything that ends up in court, other than small claims, will be heard in the state or federal courts located in Texas, and you and we agree to their jurisdiction.
14. Changes to these Terms
We may update these Terms. We'll post the new version here with a new date at the top, and for material changes we'll tell you before they take effect, by email or with a notice on our site. If you keep using our services after that, you're agreeing to the new version. Changes won't apply to a dispute that has already started.
15. The rest of the fine print
- These Terms, together with our Privacy Policy, Refund Policy, Earnings & Risk Disclaimer and anything you agree to at checkout, are the whole agreement between us.
- If a court or arbitrator finds part of these Terms unenforceable, the rest still stands.
- If we don't enforce something right away, we haven't given up the right to.
- We can transfer these Terms if our business is sold or reorganized. You can't transfer them without our written OK.
- You agree that we can send you notices and agreements electronically, by email or on our site.
